These Terms of Service (“Terms”) govern your use of www.soundoasis.com and your purchases from Sound Oasis, a brand of Headwaters, Inc., Marblehead, Massachusetts (“Sound Oasis,” “we,” “us”). By using the site or placing an order, you agree to these Terms, our Privacy Policy, and our Return Policy.

1. The site

The site is for personal, non-commercial use. You may not copy, scrape, or misuse our content, product images, or trademarks. We may refuse service, cancel an account, or limit orders that look fraudulent, resale-oriented, or in violation of these Terms.

2. Products

Sound Oasis products are sound and sleep-therapy devices for general wellness. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. Results vary. Nothing on the site is medical advice. Talk to a clinician about tinnitus, hearing loss, or sleep disorders.

We try to show colors, features, and specifications accurately. Small differences between the site and the product you receive are not defects.

3. Orders

Your order is an offer to buy. We accept it when we send a shipping confirmation. We may decline or cancel an order because of pricing or description errors, stock limits, suspected fraud, or a shipping address we cannot serve. If we cancel after charging you, we refund the original payment method.

Prices are in U.S. dollars and may change without notice. The price you pay is the price shown at checkout. Applicable sales tax is added where required. Promotional codes cannot be combined unless the offer says otherwise, and they have no cash value.

4. Shipping and risk

We ship to the addresses shown at checkout. Delivery dates are estimates, not guarantees. Title and risk of loss pass to you when the carrier receives the shipment. If a package is lost in transit, contact us with your order number and we will work with the carrier or replace the order.

If we cannot ship within the time stated on the site, or within 30 days if no time is stated, we will notify you and offer a delay or a full refund, as required by the FTC Mail, Internet, or Telephone Order Merchandise Rule.

5. Returns

You may return most items within 30 days of delivery for any reason, with your soundoasis.com order confirmation. Items must be in resalable condition, in original packaging, with all parts. We pay return shipping if the item is defective, damaged in transit, or not as described. Otherwise you pay return shipping. Refunds go to the original payment method within 7 business days after we receive and approve the return.

Orders placed November 1 through December 24 may be returned through January 31. Final-sale items and opened personal-contact parts are excluded unless defective. Contact us at 1-866-625-3218 before shipping a return. The full Return Policy is part of these Terms. Marketplace orders follow that retailer’s process.

6. Limited warranty

Unless a product page states a different period, we warrant Sound Oasis products against defects in materials and workmanship for one year from delivery under normal personal use. Our obligation is repair, replacement, or refund of the purchase price, at our option. This warranty does not cover misuse, accidents, unauthorized repair, or normal wear.

Some states do not allow limitations on implied warranties. In those states, any implied warranty is limited to the same period as this warranty, to the extent the law allows.

7. Accounts and communications

You are responsible for activity under your account and for keeping your login secure. Order and support emails are transactional. Marketing emails are optional and include an unsubscribe link.

8. Intellectual property

Site content, the Sound Oasis name and logo, product designs, and text are owned by Headwaters, Inc. or its licensors. You may not use them without written permission.

9. Prohibited use

You may not use the site to break the law, interfere with its operation, submit false information, or resell products as new without our consent.

10. Disclaimer and limit of liability

The site is provided “as is.” To the fullest extent the law allows, we disclaim implied warranties of merchantability and fitness for a particular purpose. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits. Our total liability for a claim arising out of an order is limited to the amount you paid for that order. These limits do not apply where the law forbids them, including liability for personal injury caused by our gross negligence or willful misconduct.

11. Disputes

These Terms are governed by Massachusetts law, excluding conflict-of-law rules. Courts in Essex County, Massachusetts, or the federal court for the District of Massachusetts, are the exclusive venue, except that either party may bring a claim in small-claims court. You may also have rights under the consumer-protection laws of your state.

12. Changes

We may update these Terms by posting a new version with a new date. The version in effect when you place an order applies to that order. Continued use of the site after a change means you accept the updated Terms.
